The court has reserved its decision on the application for
cancellation of the bail of former DG ISI Faiz Hameed’s brother, Najaf Hameed.
Special Judge Central Shahrukh Arjumand heard the FIA’s
application for cancellation of the bail of former DG ISI Faiz Hameed’s brother
Najaf Hameed. During the hearing, Najaf Hameed appeared in the court along with
his lawyer, Mian Ali Ashfaq.
During the hearing, the FIA prosecutor took the stance
that the record belonged to the state and was altered. According to the
prosecutor, even if the matter is settled with the complainant, bail cannot be
granted, as Najaf Hameed’s custody is required for further investigation. The
FIA prosecutor requested the court to dismiss the bail of Najaf Hameed.
Advocate Mian Ali Ashfaq, while giving arguments on behalf
of the defense, said that this is a unique case in the history of advocacy that
the investigating officer himself is the complainant. The original complainant
of the case had appeared in court and stated that his matters had been settled,
and the complainant had also submitted his affidavit in court.
Advocate Mian Ali Ashfaq said that how can the investigating
officer be considered a party in this case, it is requested that the DG FIA and
the Ministry of Interior be written to take action against the investigating
officer, the status of the complainant cannot change while the FIR is the same,
the court had written in its order that the complainant appeared in court and
stated that his matter has been settled, the court order also said that the
complainant does not want to pursue the case further.
The defense lawyer further said that if the investigation
could not be done in 16 years, then what investigation will be done now? This
case does not even involve any matter of government land.
According to Advocate Mian Ali Ashfaq, the FIA has written
in the application that they were not aware of the bail, although according to
the court order, the Assistant Director Legal was present in the court at the
time of the bail. After the parties completed their arguments, the court
reserved its decision on the application for the dismissal of Najaf Hameed’s
bail.
