Tensions have increased significantly in the United States at the political and constitutional levels ahead of the 2026 midterm elections, with the Supreme Court’s recent decision being hailed as a turning point with far-reaching implications for the future of the electoral system.
In the US Supreme Court, American citizen Philip Calais and
other citizens had filed a case against the state of Louisiana for establishing
a new district on racially-based grounds, which became known as Calais v.
Louisiana.
The court ruled in the case by a majority of 6/3,
invalidating the new parliamentary district in Louisiana. A new majority-black
district was added to this district, which the lower court had already declared
discriminatory.
However, the Supreme Court ruled that this districting was
unconstitutional and based on racial grounds and reduced the representation of
minorities.
According to the court, the scope of the use of racism in
electoral districts is constitutionally limited and states cannot draw
districts on this basis that conflict with constitutional principles. After the
decision, the debate on the Voting Rights Act, districting and voter rights has
become unusually intense, while Democrats and Republicans are accusing each
other of electoral advantage and influence.
There may be possible changes in electoral districting. Democrats
say that court decisions can give Republicans an electoral advantage,
Republicans say that court decisions can give Republicans an electoral
advantage, Democrats say that the decision is a step towards an electoral
system free of racial influence. This decision is being seen as an important
precedent in electoral legislation.
After the court decision, preparations have begun for new
districting at the state level, legal battles have increased, political tension
has also increased over stricter voter registration and election laws, a new
constitutional debate has begun on state sovereignty and the role of the
federal judiciary, while allegations of electoral influence and voter pressure
have increased.
Democratic circles argue that this decision could indirectly
give Republicans an electoral advantage, because after this, states may have
more freedom in districting. According to them, this is likely to affect the
current balance of seats in Congress.
On the other hand, political analysts say that the new districting
could change the balance of power in the House of Representatives, which could
directly affect the 2026 midterm results. For this reason, preparations have
begun in several states to review electoral delimitation. According to legal
experts, after this decision, cases and appeals are expected to increase in
various states.
